The Court ruled that domain names like tatapowersolardealership.co.in, tatapowersolars.com, and others had been unlawfully impersonating the renowned solar brand, deceiving consumers.
Leading Indian solar energy provider Tata Power Solar reported that impostors were utilizing these domain names to mislead customers into believing they were authorized representatives of the company. These fraudulent websites were involved in various deceptive practices, including offering non-existent dealership opportunities, fake promotions on solar products, and soliciting payments under false pretences. The Court emphasized the significant risk these actions posed to Tata Power’s customers and the necessity of protecting the company’s trademark.
In ruling in favor of Tata Power Solar, Hon’ble Justice Mr Amit Bansal underscored the importance of safeguarding intellectual property, especially considering the company’s widespread brand recognition and annual revenues of ₹1907 crores.
